Terms of Service

Last updated: October 23, 2026

These terms are an agreement between you and Loam Labs Inc., a Canadian company based in British Columbia ("Kilter", "we", "us"), for your use of Kilter: the web app at app.trykilter.com, the Kilter iOS app, the Kilter assistant and Kilter's connection for outside AI apps (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.

1. Who can use Kilter

Kilter is built for people who live in Canada or the United States. You must be at least the age of majority where you live and able to enter into a contract: 18 or 19 in Canada, depending on your province or territory, and 18 in most of the United States (19 in Alabama and Nebraska, 21 in Mississippi). You're responsible for your account and for everything done with it, including by apps you connect to it. Keep your sign-in secure and tell us right away at support@heykilter.com if you think someone else has access.

2. What Kilter is, and what it isn't

Kilter helps you track your money and plan your finances. It brings in your accounts and transactions, categorizes them, and projects possible futures using the information and assumptions you give it.

Kilter is not financial, investment, tax or legal advice. We aren't registered as an adviser, dealer, broker or financial planner with any securities regulator in Canada or the United States, and we don't prepare or file tax returns. Projections are estimates, not predictions or guarantees: markets, inflation, tax rules and your own life will turn out differently from any model. Tax figures are our best reading of published federal, provincial and state rules and may be incomplete, out of date or wrong for your situation. Before you make a significant financial decision, check it yourself or with a qualified professional.

3. The assistant and other AI features

Kilter uses AI to categorize transactions, answer questions, suggest changes to your plans and remember things you tell it. AI can be wrong, including confidently wrong. The assistant proposes changes for you to review; you decide whether to apply them, and you're responsible for the plans and decisions you make with them. The assistant keeps short notes about you between conversations, which you can see, edit and delete in Settings.

4. Connecting your accounts

To bring in your financial data, you can connect Kilter to your banks and other institutions through a third-party data provider (Plaid), by importing files your institutions let you download (yourself or through an outside AI app you connect), or by entering it yourself. When you connect an account, you authorize us and the provider to retrieve your account information on your behalf.

  • Data providers are separate companies with their own terms. We don't control them, and we can't guarantee that a connection will be available, complete, accurate or on time. Your institution's website remains the authoritative record of your accounts.
  • If you have an outside AI app sign in to an institution's website with you and download your files, it acts for you, not for us. You're responsible for making sure that's allowed under your agreements with that institution.
  • Kilter only reads your financial data. It can't move money, make payments or place trades.

5. Connecting outside AI apps

You can connect apps such as Claude, ChatGPT or Codex to your Kilter account. A connected app can read and change your Kilter data within the permissions you grant it, and its changes are recorded in your History, where you can undo them. Those apps are run by other companies under their own terms and privacy policies: what you share with them, and what they do with it, is between you and them. You can disconnect an app at any time in Settings.

6. Your data

Your data is yours. You give us permission to store, process and display it, and to share it with our service providers, only as needed to run the Service for you, as described in the Privacy Policy. We don't sell your data and we don't use it for advertising.

You're responsible for the information you enter, and for having the right to give us any information about other people (for example, a spouse or child in a plan).

7. Plans, payments and cancellation

Some features require a paid subscription. Prices and what each plan includes are shown on our pricing page and in the app at the time you subscribe. Prices are in Canadian dollars in Canada and in US dollars everywhere else.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms apply to your purchase.

  • Subscriptions renew automatically at the end of each billing period (monthly or yearly), at your plan's current price, until you cancel. Checkout shows the price, the billing period and that it renews before you pay. We'll remind you about 30 days before a yearly subscription renews.
  • The free trial every new account starts with doesn't need a card and never turns into a paid subscription by itself: when it ends, your account moves to the free plan unless you've subscribed.
  • You can cancel at any time, online, in Settings, without having to contact us. You keep access until the end of the period you've paid for, and you won't be charged again.
  • Prices include or add sales taxes as shown at checkout. We may change prices; a change takes effect at your next renewal, and we'll tell you at least 30 days before.
  • Refunds are covered by our Refund Policy.

Paid plans include a monthly allowance for AI features (the assistant, AI categorization and the assistant's suggestions). Once it's used up, they pause until it starts over at the beginning of the next calendar month; Settings shows how much you've used.

8. Acceptable use

Don't use the Service to break the law, to access data you aren't authorized to access, or to harm the Service or other people. Don't try to get around usage limits or security, reverse engineer the Service except where the law allows it, resell it, or use it to build a competing product. Automated access is welcome through the connection for AI apps (section 5); please don't scrape the app otherwise.

9. Changes to the Service and to these terms

We improve Kilter often, and features may change or be retired. If we make a material change to these terms, we'll tell you by email or in the app at least 30 days before it takes effect. If you don't agree with the change, you can cancel before it takes effect, and we'll refund any prepaid time you won't use.

10. Ending your account

You can stop using Kilter and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms, if required by law, or if we stop offering the Service; unless it's urgent, we'll give you notice and a chance to export your data first. If we close your account without cause, or stop offering the Service, we'll refund any prepaid time you won't use.

11. Warranty disclaimer

We work hard to make Kilter accurate and reliable, but the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties that aren't stated in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that it will be uninterrupted, error-free or accurate, or that projections or tax estimates will match what actually happens.

12. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for financial decisions you make using the Service, and our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and $100 (in Canadian dollars if you live in Canada, in US dollars if you live in the United States).

13. Your rights under consumer protection law

Nothing in these terms limits rights you have under the consumer protection laws of your province, territory or state that can't be waived by contract. Some provinces and states don't allow excluding certain warranties or limiting certain damages, so parts of sections 11 and 12 may not apply to you. If you live in Quebec, some of the clauses above, including sections 11 and 12, may not apply to you under the Consumer Protection Act.

14. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If you're a consumer, you keep the protection of the laws of the province, territory or state where you live that can't be waived by contract, and you can also bring a claim in the courts there.
